SoCal Edison's fraudulent behavior regarding the Replacement Steam Generators at San Onofre

Here is a typical description of the legal meaning of the word "fraud":

Fraud:

A false representation of a matter of fact ­- whether by words or by conduct, by false or misleading allegations, or by concealment of what should have been disclosed -­ that deceives and is intended to deceive another so that the individual will act upon it to her or his legal injury.

Fraud must be proved by showing that the defendant's actions involved five separate elements: (1) a false statement of a material fact, (2) knowledge on the part of the defendant that the statement is untrue, (3) intent on the part of the defendant to deceive the alleged victim, (4) justifiable reliance by the alleged victim on the statement, and (5) injury to the alleged victim as a result.

Fraud is commonly understood as dishonesty calculated for advantage.

The actions of Southern California Edison (SCE) in pushing their Replacement Steam Generators (RSGs) for San Onofre Nuclear Generating Station (SanO) through the California Public Utilities Commission (CPUC) (for ratepayer funding) and through the Nuclear Regulatory Commission (NRC) (for safety approval) amounts to fraud. Presented as "like-for-like" with the Original Steam Generators (OSGs), the RSGs were in fact significantly UNLIKE the OSGs -- and (as we all now know) not only unworkable but UNSAFE. In this writer's opinion, SCE's actions have reached the level of criminal negligence, since the lives and livelihoods of almost 9 million people who live and work within 50 miles of the plant are at stake. Where an abundance of caution should have been used, SCE instead was focused on shareholder profits.

SCE's actions satisfy all five requirements listed above to prove fraud.

First: A false statement of a material fact.

Edison claimed, falsely, that the RSGs were a "like-for-like" replacement, and therefore they did not need to go through a public review process. While Edison publicly disclosed that the RSGs would be made with a different alloy (Inconel 690), they only said it was more resistant to stress corrosion cracking (SCC), fretting, and other forms of fatigue than the alloy used in the tubing of the OSGs (Inconel 600). These problems had plagued the industry's first generation of steam generators and led to the permanent shutdown of SanO Unit 1 in 1992. However, left unsaid about the new alloy was another important property: Inconel 690's heat transfer coefficient is about 10% lower than Inconel 600's, which necessitated numerous additional changes to the RSGs in order for them to generate the same amount of steam as the original OSG design. These unproven changes were kept hidden from the public, but are now known to have included:

A) Much tighter spacing of the steam generator tubes to approximately 3/4 inch (versus about one inch in the OSGs), with a new triangular spacing pattern (versus a square spacing pattern in the OSGs).

B) Reducing the distance between each tube in the U-bend region to as little as 0.05 inches between some of the tubes. The industry norm is between 0.35 and 0.55 inches; the design (intended) spacing was 0.25 inches. This tighter packing of the tubes allowed them to clang into each other more easily, which increased wear damage (the rupture on January 31, 2012 which disabled Unit 3 was in the u-bend region of the tube bundle).

C) Adding over 370 tubes per steam generator, which also, along with the tighter spacing of the tubes, reduced the available flow area of the secondary coolant loop.

D) Lengthening of the tubes by an average of nearly 2 1/2 feet per tube, which had several detrimental effects, including allowing the longer tubes to vibrate at a lower level of turbulence, and reducing the open space above the u-bend of the tubes, which prevented the steam from properly exiting the top of the u-bend region before entering the swirl vane moisture separators. This may have increased the "Mitsubishi Flowering Effect," further weakening the tubes, especially just above the tube support plate (TSP) located at the top of the straight portion of the tubes at the base of the u-bends.

E) The reduced space available in the secondary coolant loop altered the flow characteristics of the steam/water mixture in that loop. Proper flow is required to transfer heat away from the primary coolant loop, which flows through the reactor at about 2,500 gallons per second, at about 2200 pounds per square inch of pressure, and exits the reactor at about 600 degrees Fahrenheit. These design changes caused steam "dry-out" (too much steam (more than about 99.6%) and not enough water (less than about 0.4%)) in the steam/water secondary coolant loop mixture. The dry-out conditions resulted in heat being transferred less efficiently, which in turn, also changed the flow characteristics of the RSGs. The net result was significantly increased flow rate of the secondary coolant loop's steam/water mixture within the U-tube bundle, and simultaneously, significantly reduced damping of any tube movement that occurred for any reason.

F) Removal of a "stay cylinder" in the center of the steam generators (to make more room for additional u-tubes) may have allowed an increase in vibration and thus, fatigue.

Among other effects, these changes reduced the normal 'nucleate boiling' on the outer surfaces of the tubes due to excessively dry steam. This in turn caused additional thermal stress, cavitation, and fatigue when the remaining bubbles of steam "exploded" on the hot, dry tube surfaces. Damage from this phenomenon is not easily diagnosed and has not been properly inspected for, yet SCE is now putting pressure on NRC to restart the reactor by claiming to have done a "thorough" inspection of all the tubes -- even though much better inspection equipment is available which SCE has decided not to use. Fatigue damage specifically has barely been inspected for (tube-to-tube wear has been concentrated on, instead).

Edison also claimed that all four RSGs (two per reactor) were virtually identical, yet they now claim that small differences in manufacturing procedures make Unit 2's RSGs sufficiently different to be safely restarted. In reality the manufacturing differences were not significant; the operational differences between the two reactors were why Unit 3 suffered more extensive damage, faster, than Unit 2.

Second: Knowledge on the part of the defendant that the statement is untrue.

A) SCE required MHI to withhold certain safety improvements specifically to prevent a thorough NRC review process that would have also allowed public scrutiny of their new steam generator design. Thus, they were well aware that their claim that "safety is their highest priority" is blatantly untrue.

B) SCE has repeatedly stated that the nuclear waste problem is not a problem because of "Yucca Mountain." But the proposed Yucca Mountain storage facility was never a viable solution to the nuclear waste problem and was never even close to being placed into service, due to both the geology of Yucca Mountain specifically (earthquake faults, water seepage, etc.) and due to the intractable, destructive nature of nuclear waste generally. The fact is, ionizing radiation (by definition) can destroy any containment you put it in. Furthermore, vermin will move the waste away from the dump site, as will flowing groundwater, and the radiation will continue to be hazardous for many millennia.

C) SCE falsely claims that SanO can help reduce global warming because, according to them, it does not release greenhouse gases. This is untrue: The nuclear fuel cycle is extremely carbon-intensive during mining, milling, and enrichment of the uranium oxide fuel, during construction of the reactor (along with all its replacement parts), and during the decommissioning process. Carbon emissions occur throughout the operating life of the reactors as well, as approximately 1,500 people work at the plant, drive to work, etc.. After decommissioning, the radioactive trash (spent fuel) continues to release ozone-damaging and DNA-damaging ionizing radioactive particles, along with thermal heat. Guards, guns, and guard dogs will be needed for thousands of generations, at a cost of tens of millions of dollars per year per reactor. For these reasons nuclear power is not a solution to global warming, but instead is a significant part of the problem.

Third: Intent on the part of the defendant to deceive the alleged victim.

A) SCE stated to the NRC on 4/5/2013 that Southern California "needed" SanO for grid stability, voltage support, and to address customer demand for electricity. Yet the California Independent System Operator (Cal-ISO) has shown that there is plenty of electricity available and furthermore, SCE has undertaken NO attempt to replace SanO's electricity with clean, green alternatives in the 16 months since the tube rupture made it apparent that Unit 3 could never, and Unit 2 should never, come back online in their present condition. In fact SCE appears to be attempting, through their inaction, to CAUSE blackouts this summer in order to justify their claim that SanO is "needed." The reality is that nuclear power plants are notorious for not staying online, and with only one reactor (at most) operating, an alternative energy plan SHOULD HAVE ALREADY been put in place. Yet no such plan is being implemented, as SCE keeps stalling while hoping for an extraordinarily hot summer, along with maybe a few downed high-power transmission lines. Any blackouts or brownouts, regardless of their cause, will be pointed to as "proof" that SanO is needed, even though they might have occurred anyway, and SanO might have gone down for a variety of reasons anyway. What SoCal really needs is additional wind energy, solar energy, demand response, and other clean alternatives.

B) SCE's claim that grid stability will be compromised by too high a percentage of renewable energy has been proven false by, for example, Portugal's success with turning to renewables (now over 70%), and Germany's (over 25%). Germany's goal is 45% renewable energy by 2030, and 80% to 100% renewable energy by 2050. California can and should be a global leader in renewable energy.

C) SCE stated on 4/8/2013 that: "Operating [Unit 2] at 70 percent power prevents conditions that caused the tube-to-tube wear in Unit 3 that resulted in the nuclear plant being shut down since January 2012." This is a misleading statement and a misrepresentation of fact. Firstly, SCE is only speculating and does not know for sure that Fluid Elastic Instability (FEI) can be prevented at 70% power. Secondly, SCE is completely ignoring dangerous tube behavior that can occur during operational transients (such as the opening or shutting of valves,start-up, shut-down, etc.), tsunamis, earthquakes, and/or during a Main Steam Line Break (MSLB) condition. Thirdly, describing a 70% power reduction at the turbine, while operating the reactor at approximately 100% (normal) power (which is the true intent of SCE's plan) is very misleading, and is intended to lull the public into thinking Unit 2 will just limp along quietly with no safety problems.

D) SCE, in attempting to justify restart of Unit 2, claimed to the public and the media that new "acoustic listeners" would help SCE avoid a repetition of the January 31, 2012 tube rupture and leak. But this claim was proven false when NRC questioning revealed that the listeners would only provide data to be analyzed later and would offer no real-time protection or early warning about tube wear problems. This was A purposeful obfuscation on the part of SCE to hoodwink the public into thinking SCE would be able to tell beforehand if there is tube damage which might cause a rupture. They can't tell, as proven by the fact that Unit 2 had one tube with 90% tube wall wear, and numerous tubes that had exceeded their safety limitation of 35% tube wall wear, and SCE had no knowledge of this fact until Unit 2's RSGs were re-inspected more carefully after the radiation leakage was discovered in Unit 3.

E) In 2004 when they applied to the CPUC to force ratepayers to cover the cost of the RSGs, SCE claimed that the project would somehow save about a billion dollars for ratepayers over a 20 year period -- about 50 million dollars a year. It has already cost ratepayers far more than that, and continues to cost ratepayers nearly 70 million dollars each MONTH while we wait to have a decision about restart. The RSGs in Unit 3 ran for less than a year and can never be used again, and the RSGs in Unit 2 ran for less than 2 years and should also never be used again. SCE should have foreseen these problems specifically, and other problems generally, and included such costs in their analysis. If they had, no one would have approved the replacement steam generator project.

Fourth: Justifiable reliance by the alleged victim on the statement.

A) Despite numerous activists and experts outside the nuclear industry (and their too cozy federal regulators) using sound engineering principles to explain why Unit 2 should not be restarted (John Large, Joram Hopenfeld, Arnie Gundersen, Michel Pettigrew and others), the vast majority of SoCal's population only hears what SCE says and the media repeats, because SCE has an enormous PR budget (paid for by the ratepayers). After all, SCE has the nuclear experts, right? (Who just happen to include the ones that designed the defective RSGs.) In actuality, the above-mentioned gentlemen are among the world's leading experts in nuclear reactor steam generators. Not one of them believes Unit 2 can be restarted safely with the current pairs of steam generators.

B) SCE has, through careful wording of their statements to the NRC, attempted (and largely succeeded) in convincing the NRC that a restart may be possible, despite the known (and unknown) tube damage that has already occurred. The public -- the victim -- is being hoodwinked by SCE and NRC "experts" who toss technical statements back and forth, asserting that neither of them will allow an unsafe restart -- and yet, as outside experts have shown, that is the only kind of restart that is possible. SCE is counting on the public to believe that NRC will oversee SCE properly, and since the majority of the public is unaware of the "regulatory capture" that has occurred within the NRC, SCE may get their wish. Meanwhile, the actions of SCE and NRC are quietly being investigated by a number of federal and state oversight groups: The Security and Exchange Commission, the Atomic Licensing Review Board, the NRC Inspector General's office, the CPUC and others.

Fifth: Injury to the alleged victim as a result.

A) There are nearly nine million people who live and work within 50 miles of San Onofre. They might all be affected by a restart decision if there is a meltdown, which might cost more than a trillion dollars and permanently displace millions of people, along with causing hundreds of thousands of deaths. Such enormous numbers are indicated not only by the actual events around Chernobyl and Fukushima, which, bad as they were, were not as bad as they could have been or could be at SanO, but also, by the figures cited in the 1982 federal report known as CRAC-2 (a report which seriously underestimated the average number of meltdowns the world would experience over time, as well as the size of populations around the plants, time needed to evacuate, and damage to human health from radiation).

B) If there is an accident, the federal Price-Anderson Act of 1957 will prevent victims from obtaining reasonable compensation from SCE for damages and injuries that will result. The act limits nuclear industry liability for an accident to about 12 billion dollars.

C) Even if there is no meltdown of the reactor, restarting it will result in increasing the amount of spent fuel stored on site (or stored somewhere), the costs and risks of which will be borne by future generations of citizens, not SCE. The lethality of the waste will continue for hundreds of thousands of years as radioactive decay products transform from one radioactive element to another, and another (sometimes dozens of steps), until a stable element is reached.

D) Even if there is no accident, all of SCE's projections of future savings for the ratepayer are based on wishful thinking: SCE hopes that SanO will operate successfully for the next 20 (or 40) years, but there is no guarantee that other problems will not arise, and nor is there any assurance that safety changes expected to be required over the next few years due to lessons learned from the Fukushima accident will not make operating SanO even less cost-effective than it would be anyway.

In Summation:

Southern California Edison has committed fraud against the people of Southern California. It is time that both the California Public Utilities Commission and the State Attorney General put a stop to SCE's unlawful practices. SCE continues to propose restarting Unit 2 with damaged and defective steam generators, which poses a serious and substantial risk to all Southern Californians. Relief for the ratepayers is demanded by immediately starting the decommissioning process for the "San Onofre Nuclear Waste Generating Station."

A million dollars a day, that's why...

(Author's note: This newsletter was written on Thursday, the day before Jaczko's visit to California...)

Dear Readers,

[On Friday April 6, 2012] a small group of California-based activists [had] the opportunity to meet with Nuclear Regulatory Commission Chairman Gregory Jaczko, who [had] come out to California to personally oversee the problems at the San Onofre Nuclear (Waste) Generating Station, which sprung a leak last January and has remained closed ever since (and note that the lights have remained on throughout the Southland in the 2+ months since the outage began).

Jaczko is under tremendous pressure right now. Both to keep the plant open AND to shut it down. But he has a duty to fulfill. Will he do it?

The other four commissioners have been in collusion to mutiny ever since Fukushima, if not before. They are much less interested in applying the "lessons learned" from Fukushima than he is -- "lessons" that are well short of "permanent closure everywhere", which would seem the logical thing considering how devastated the area around Fukushima is now, and will remain for hundreds or even thousands of years. And considering that the "lessons" are more like band-aids than fixes: For example, requiring several days' worth of battery backup instead of mere hours. Maybe that SOUNDS good -- but the entire battery backup concept is seriously flawed to begin with, in part because it has so many bottlenecks, and in part because it relies on humans to connect everything up correctly, test it properly, maintain it regularly, know how to use it when it's needed, AND who are willing to stick around while all hell is breaking loose around them. It's a flawed system, that's all I'm saying...

I don't know what Jaczko expects to see when he comes out here that could possibly give him confidence in San Onofre. The plant is owned and operated by belligerent liars. They lie to each other, they lie to the media, they lie to the public, they lie to the Nuclear Regulatory Commission, and they lies to themselves, thinking "a little radiation is safe" or even "a little radiation is good for you." So every mistake, if they are shielded properly from it, or if it is diluted sufficiently before it reaches the public, is harmless, in their eyes. A bigger leak just needs more dilution for the public, or more shielding for them, or they spread the job out among many workers, including the ever-present "disposable" sub-contractor workers.

They even leave their dosimeters off when they go into highly irradiated areas, so they don't accumulate too high a dose and have to stop working on the "fun" stuff, and maybe even get laid off. Nuclear workers do THAT all over the world! In Fukushima they even are doing it, where the doses are hundreds of times higher, or thousands of times higher than what workers are likely to receive at San Onofre.

At San Onofre they falsified inspection reports for fire rounds they were supposed to be making because they were too cheap (and still are) to install 24/7 full-time automated fire monitoring systems, which have been required at nuclear plants for decades, since a nearly-disastrous fire at the Brown's Ferry reactor site. Reactor operators were given a choice: Do the fire watch rounds, or buy the proper equipment. SanO choose to falsify doing the rounds, instead.

Now it's being reported by renowned nuclear expert whistleblower Arnie Gundersen of Fairewinds Associates that San Onofre's operators apparently tried to pull a fast one on the Nuclear Regulatory Commission, the California Public Utilities Commission (CPUC), and on the public, by pretending the new steam generators were "like-for-like" replacements for the old ones when in fact they were redesigned to have higher heat throughput -- but the changes actually made them wear out more rapidly!

San Onofre is the #1 reactor site in the country -- #1 for problems such as intimidating workers to prevent them from reporting problems to the NRC! Yet they are ALSO #1 for safety-related complaints. I'm not sure what that proves, but it isn't good.

So what's Chairman Jaczko going to see at the plant? What's he going to hear them tell him that will make everything good? Why can't we ALL see the results of Southern California Edison's research into why their almost-new billion-dollar steam generator tubes are rupturing, wearing out prematurely, and failing pressure tests, way beyond industry standards and even way beyond safety limits set by the Nuclear Regulatory Commission itself!

We all know Southern California Edison had already decided not to restart Unit II after a refueling outage and other maintenance was performed, because of finding hundreds of excessively-degraded steam generating tubes with no known cause.

The real question is, WHY DIDN'T THEY SHUT DOWN UNIT III once they saw the severity of the problem with Unit II?

A million dollars a day, that's why. The reactors, when operating, produce a million dollars a day per reactor in revenue for their owners. THAT clouded their thinking. (Money ALWAYS clouds people's thinking.)

Can you get much closer to Fukushima USA than a cascading failure of the steam generator tubes at San Onofre? That's without an earthquake, of course, let alone a tsunami, wildfires caused by downed power lines, cracked highways and rail lines, and general chaos all around the Southland. Just TRY getting a big-as-a-locomotive emergency diesel generator to San Onofre after a natural disaster blocks all the roads, there's no Internet or phone lines for SanO either, desperately calling out for help (satellite communications down due to solar flares, of course...).... and their onsite EDGs not working because they toppled because the "over-engineered" bolts had rusted away and no one noticed... until the earthquake! I'm not saying this EXACT scenario is going to happen, but it's one of thousands that COULD happen...

How close did we come in January, 2012 to Fukushima USA? Close enough. Southern California Edison could have EASILY avoided that near-miss by recognizing that the tube degradation they saw in Unit II's steam generators "might indicate" that there would be a problem in Unit III! That's ALL they had to do! The activists were calling for shutdown at the time, of course -- for just that reason: Inspect the steam generators, something's wrong.

But of course, they are ALWAYS calling for shutdown, because the old plant is always falling apart at the seams and is a daily threat to our homes, our lives, our children's future. It's in constant threat of meltdown if anything goes wrong, and it leaks all the time anyway.

According to the National Academy of Sciences' Biological Effects of Ionizing Radiation VII report (a many-inches-thick multi-volume document), there is NO threshold for radiation's effects, and those effects generally occur in a linear fashion all the way down to the lowest possible measurable dose rate.

Whenever San Onofre leaks some radioactive primary coolant into the secondary loop, some radiation is released when that steam is condensed. Then the rest of the leaked radiation is released in dribs and drabs throughout the system over time.

Such leaks are always said to be "small" or even "negligible" amounts. But how much is "small"? And what does "negligible" mean anyway when the severity of many of the effects of radiation is NOT reduced as the dose is reduced -- either you get cancer or you don't, for example. What IS reduced as dose rate is reduced is the LIKELIHOOD of suffering such a health effect.

One of the ways of measuring a radiation leak is by considering how quickly the isotopes decay. Fast-decaying isotopes are asserted by the nuclear industry to be "almost harmless" because they decay away quickly and can't drift very far before they've decayed to something stable. Long-lived isotopes are said to be "almost harmless" because they decay away slowly. Those with half-lives in the range of human lives are considered to be the most dangerous -- and are the least talked about.

Another way of measuring a radiation leak is to consider how fast the wind blows (for radioactive gases) or how much water is needed to dilute a liquid release to "legal" levels. TEPCO was delighted that during their most massive releases from Fukushima in March 2011, winds were strongly out to sea (and towards the western coast of the United States). The winds around San Onofre blow inland, over the local populations, most of the time.

Another way of measuring a radiation leak is to calculate how much air the average person inhales in an average day, how much water they drink, etc.. and then guess what portion of that air or water will be radioactive. One must know what radioactive elements leaked, so you can guess what part of the body they might lodge in and what their biological effects are when they decay.

Another way of measuring radiation is to assume everyone is the average age, and multiply the presumed exposure level per person by the number of people presumed to be exposed. But since the young and old alike are more susceptible to radiation's dangers, as well as the already-infirm, that method too has obvious flaws that favor the nuclear industry's rosy assessments. Averaging such numbers doesn't help those of us who are NOT average!

By the time they're done with their calculations of the effects, as they see it, nobody gets a very high dose, and nobody gets hurt. Radiation releases, even billions of Curies such as was released at Fukushima, that caused thousands of square miles to be evacuated, much of it probably for many generations, actually harmed no one, according to the nuclear industry. It just isn't so.

San Onofre is legally allowed to release radiation to the environment all the time. For example, they can legally release about a thirtieth of a teaspoon of tritium each year -- as long as it's properly diluted. By volume, that's not a lot of tritium, but it has to be diluted in billions of gallons of water to be below the legal thresholds for tritium in drinking water. Conveniently, the plant runs billions of gallons of ocean water through its cooling system every day, so they can dilute the tritium as much as they need to, in order to be allowed to release it legally into the environment. That doesn't make it harmless, that just "hides the bodies".

And to help them out, the Nuclear Regulatory Commission will INVARIABLY give any nuclear power plant that has an excessively large radiation release a SPECIAL PERMIT for that event -- post-dated, of course. And that's only if they FIND OUT about the release since they rely on industry reporting! San Onofre leaked an unknown quantity of tritium under the closed-and-dismantled (also for steam generator problems, by the way) Unit 1 for DECADES and the NRC never did anything about it, and it undoubtedly leaks tritium under Units II and III whenever it's running now, too.

Right now, San Onofre is shut down and if Chairman Jaczko looks the least bit carefully, he should be able to see up close what any fool can see at a distance: San Onofre is an accident waiting to happen. We've come close here countless times, but this latest problem is costing the ratepayers hundreds of millions of dollars while Southern California Edison awaits the Nuclear Regulatory Commission's "go-ahead" to restart the reactors with faulty steam generators and band-aid fixes, OR they are awaiting the more obvious determination -- that the steam generators do, in fact, have to be replaced because bursting seven tubes in pressure tests and one while running is a BIG NO-NO in the nuclear business, and if ANYONE restarts that reactor NOW and EVEN ONE steam generator tube ruptures in EITHER reactor, someone should go to jail... with or without an ensuing meltdown.

Everyone admits that the steam generators are vital to keeping the reactor safely operating -- a cascading failure of the tubing could be catastrophic. Period, that's not debatable.

What isn't being mentioned is that San Onofre's are not only among the dozen or so largest steam generators in the world, they ONLY have two each and that's also unusual and NOT GOOD because a failure in one leaves ONLY one steam generator still operating -- and that's NOT a lot of backup when metal parts are flinging throughout the reactor, water is gushing out and flashing to steam at 2200 psi pressure (rapidly dropping), and the control rods aren't inserting properly because the rush of water out the hole produced unexpectedly high flow rates in the reactor! Nasty!

Okay, maybe they'll get lucky -- they have so far. But for the cost of a few billion dollars which is going to probably get spent one way or another anyway, they can do the right thing. Instead of fixing that old jalopy from head to toe (because "new" reactors are forbidden by law in California) and HOPING it works again, or worse yet, instead of only fixing what they can get away with, which is what they want to do, they COULD put that money directly into renewable energy solutions, conservation solutions -- ANYTHING but San Onofre.

Lastly, one should never forget that EVEN IF SanO NEVER melts down, we still have the GROWING problem of the nuclear waste it creates. As the waste cools, it becomes thousands of times less difficult to handle, but this happens very slowly, over a period of 5 to 10 years, and in any event, the waste does NOT become safer for hundreds of thousands of years IF something DOES go wrong -- for example, if an airplane were to crash into a "dry cask" storage container. Not irrelevant considering the dry cask "farm" at San Onofre is DIRECTLY under several major flight paths, and already contains over a MILLION POUNDS of radioactive waste, and is destined to contain TENS OF MILLIONS OF POUNDS of radioactive, vulnerable, "spent" fuel.

So we need to stop making more of this toxic waste immediately. There is no solution to the waste problem, and after 60 years and at least 60 billion dollars spent on Yucca Mountain and other proposed solutions, no scientifically credible solution is anywhere on the horizon. All that waste will just sit on our coast,. a danger to the whole world, for centuries. It's time to stop making things worse, it's time to stop increasing the risk daily. It's time to find alternatives to nuclear power. It's time to shut San Onofre forever.

On March 29, the National Academy of Sciences released a 460-page report about cancer risks associated with living near a nuclear power plant. They recommended six areas in the United States for intensive studies of possible cancer links. Our area was one of the chosen six: They want epidemiological studies done for towns within 30 miles of San Onofre Nuclear Generating Station. Is south Orange County becoming the poster child for a place where it is dangerous to live, work or bring up a family?

While many are concerned about accidental radiation leaks such as those in January, the dirty little secret is that reactors routinely release radiation without announcement. Air ejectors release radioactivity into the atmosphere and pumps discharge radionuclides into the ocean. Regulations on the deliberate release of radioactivity are specified in the Nuclear Regulatory Commission's federal code in which reference is made to ALARA or "As Low As Reasonably Achievable." Knowing that nuclear power plants cannot operate without regularly releasing low-level radiation, government agencies allow them to do so. Without monitoring, we have no idea what is released or when. Edison is not required to announce either the dates or concentrations of these secret releases. They do post yearly averages, but we have no way of knowing if the numbers are the result of possibly dangerous levels on some days averaged with no releases on other days. The industry claims that these doses are low for adult males, but to have radiation released year after year, decade after decade is problematic, especially for children.

If you want to know what San Onofre released two years ago, study Edison's own reports to the NRC. In 2010, the list included 34 radionuclides, including some of the most toxic substances on the planet. There were 44 hours of atmospheric batch releases and 550 hours of liquid radioactive releases into the ocean. How many surfers are aware of this? In addition, Edison trucked 27 flatbed trailers of radioactive solid waste to Utah, through San Clemente and lots of other towns.

Many have difficulty fearing invisible microscopic radioactive particles. We do know that radiation causes cancer, but some disregard health threats that take years to develop. Individual doses are made to sound insignificant, but the effects are cumulative. Children are 15 to 20 times more vulnerable to radiation, and the fetus is 30 to 50 times more sensitive. Recent studies published in the International Journal of Cancer, reported that children living near nuclear power plants in Germany and France are twice as likely to get childhood leukemia. In California alone, there were 56,030 cancer deaths in 2011 and 163,480 new cases of cancer. No one knows the exact cause of most cases, but experts tell us that the vast majority of cancer has environmental origins.

If San Clemente wants to be a safe place to live and work, shouldn't we have radiation monitoring of air and water plus epidemiological studies to learn if we are being harmed? This was the main issue at a recent City Council meeting where droves of citizens lined up to request radiation monitoring. When City Councilwoman Lori Donchak courageously made a motion to ask for independent publicly accessible radiation monitoring in town, the other four councilmen refused even to second the motion. The council ignored the warnings of City Manager George Scarborough who pointed out that the current real time monitoring near the plant is not available to the public. Council members said that everyone should trust the authorities and that those who favored increased safety for San Clemente were engaging in fear mongering.

Perhaps the main lesson learned from Fukushima is the collusion between government and industry. The government and the nuclear industry in Japan lied about radiation dangers before, during and after the meltdown. The tab for Fukushima is already $300 billion and still rising. It seems reasonable that anyone living in the shadow of San Onofre should be skeptical of those who are willing to risk our future. We should trust scientists long before we trust those who profit. In 2006, former Soviet President Mikhail Gorbachev remarked that it was Chernobyl that really caused the downfall of the former Soviet Union. One serious accident here might do the same thing to our country.

It's definitely time to decommission San Onofre!

Dear Readers,

It's time to decommission San Onofre Nuclear Generating Station. It's the only sensible thing to do. It makes economic sense for just about everybody, and spares us the possibility of "Fukushima USA" here in SoCal.

Right now, neither of San Onofre's two reactors are operating. Southern California Edison is already predicting there could be rolling blackouts during the summer if they can't get the reactors running by then. The threat of blackouts is at odds with the historic record of energy usage, which clearly shows that there is more than enough electrical generating capacity and transmission line capacity in SoCal to replace San Onofre.

Nevertheless, SoCal residents can EXPECT rolling blackouts -- because SCE wants them to happen: It may cost as much as a billion dollars (or more) to repair San Onofre. Instead SCE could be securing contracts NOW for summer energy use. They could be building a billion dollars' worth of solar rooftops, offshore wind turbines, turbine peaker plants, cogeneration plants, energy storage reservoirs, geothermal energy systems, etc..

But they don't want to, because when San Onofre is operating, it's "easy money": A million dollars per day per reactor! So instead they'll want to "prove" that SoCal "needs" San Onofre, so they won't prepare, the blackouts will happen, and then they'll expect us, the ratepayers, to pay for it all!

Meanwhile, there is still NO solution to the problem of long-term storage of nuclear waste, which has been piling up for decades in dangerous "temporary" locations at every nuclear power plant in the country (and nor will there ever be a good solution). And NOR is there a solution to the dangers of nuclear weapons proliferation, which SanO exacerbates by producing plutonium and tritium. Additionally, the dangers from terrorism, or from mother nature's fury, remain unsolved too. San Onofre is built on or near several fault lines, and along the coast, nearly at sea level. It's tsunami-prone and earthquake-prone. And surrounded by about eight million people within 50 miles (noting that the U.S. Government recommended U.S. citizens evacuate from within 50 miles of Fukushima, Japan -- and ALSO noting that even that might not be far enough!).

Furthermore, San Onofre continues to have problems with worker harassment (intimidation of workers to prevent them from reporting dangers) AND, paradoxically, worker safety complaints (that safe procedures aren't being followed). San Onofre is officially (Nuclear Regulatory Commission's own data) the worst-run commercial nuclear facility in the nation on BOTH counts.

A meltdown at San Onofre would be the ruination of SoCal. And we don't need a tsunami or "the big one" to cause it: It's not inconceivable that a thing as simple as a flashlight dropped in the reactor water could start a cascade of failures, leading to a meltdown "just like" Chernobyl or Fukushima. That's why they have regulations to prevent things like dropped flashlights (I mention this specifically because it happened there last month, and the contract worker, a temporary employee at the plant, who violated workplace rules by dropping the flashlight, then further violated the rules by trying to retrieve it -- and falling in!)

SCE doesn't want to be responsible for ANY of the costs to fix the reactors. They just want to fix them any way they can, so they can restart them as soon as possible, so they can go back to making money -- and creating a ton a week of highly dangerous "spent fuel" which will be the real legacy of San Onofre's decades of operation: Millions of pounds of deadly poison sitting on our shoreline just waiting to be released by accident/sabotage, etc.. Southern California Edison will be long out of business, all of us will be long dead, California will be a nation unto itself (perhaps), but the waste will still be here.

The cause of San Onofre's current shutdown is defective replacement Steam Generators (SGs) made in Japan by Mitsubishi Heavy Industries. MHI has been building SGs for nuclear power plants since the 1970s and have manufactured, shipped and installed well over 100 SG units around the world. MHI's current annual report indicates they plan to double their nuclear steam generator business several times in the next three years to almost $10 billion annually. So this is a big setback for them as well as for SanO's owners. The problem is almost surely the result of incorrect manufacturing procedures: This didn't have to happen. What other SGs around the world are in trouble?

Steam Generators are massive things used in Pressurized Water Reactors (PWRs). PWRs have three coolant loops: Water under very high pressure in the primary loop goes through the reactor core, gets heated (and irradiated), and then goes through thousands of very thin tubes inside the steam generators.

San Onofre's two SGs each have nearly 9,500 long, thin U-shaped tubes (the tube's walls are about the thickness of a credit card). Because the water inside the thin tubes is highly pressurized, it does not boil. The water on the other side of the tubes (the secondary coolant loop) comes in contact with the hot tubes and turns to steam. The steam is piped out of the containment domes and into the turbine room, where it is used to turn the turbines which generate electricity. A third coolant loop (ocean water) condenses the steam in the second loop, and that condensate is then pumped back into the steam generators again.

When any company receives $800 million worth of equipment, it invariably inspects that new equipment very carefully to make sure it's exactly what they ordered. San Onofre's replacement steam generators were inspected when they arrived at the plant in 2009, and found to be defective. MHI had to send out a special team to SoCal to reweld them. Like the defects that are appearing now, those defects SHOULD NEVER HAVE MADE IT OFF THE FACTORY FLOOR.

You can be sure numerous additional inspections were done after the problems were discovered in 2009. The additional inspections and repairs took about six months. Then they put the steam generators in the reactors (two SGs in each of two reactors) and just over a year later... problems, problems, problems!

The first problems to show up were in Unit II, the older of the two operating reactors and the one to get its steam generators replaced first. Excessive wear was discovered on the thin U-shaped tubes inside the SGs, when were inspected during Unit II's first refueling outage after the SG replacement. The outage was already far from "routine" despite repeated assurances by the utility that it was "just" a routine refueling outage: The Reactor Pressure Vessel Head was being replaced, which is another massive (and expensive!) part which had worn out prematurely. Neither the RPVH nor the SGs were ever supposed to wear out in the entire life of the plant.

Unit II's SG wear is significant: Two tubes had at least 30% wear, and nearly 70 tubes had at least 20% wear, and about 700 tubes had at least 10% wear. The new SGs are expected to last 40 years or longer -- but all of this excessive wear was detected after only about 14 months of operation! PWRs rely on the SGs to remove excess heat from the reactor. They are a vital safety component of the reactor, which is one reason there is a minimum of two SGs per reactor (sometimes more than two) in every PWR in the world -- in case one fails.

San Onofre's engineers were quick to explain to the media and the public that the wear they found on Unit II was probably just wear from "settling in": The parts merely had to "get comfortable" with each other. I actually heard SanO employees using these "engineering" terms!

Then Unit III's steam generators failed, too -- and it was "discovered" the hard way: A rupture. One of the nearly 20,000 tubes inside Unit III's SGs suddenly burst, and the subsequent release of primary coolant -- which is highly radioactive -- into the secondary coolant loop -- which normally isn't very radioactive -- caused the control room operators to have to shut down that reactor as well. Some radiation was released to the atmosphere (and to the public) when the radioactive steam condensed back to water at atmospheric pressure.

Calling what happened Last January merely a "leak" is being too nice: It was an extremely violent flashing to steam of super-heated, super-pressurized radioactive water and chemicals. (If you passed your arm accidentally over the breach, it would take your arm off (by steaming it off!) in an instant. (But at least the stump would be sanitized.))

Such steam generator tube ruptures are rare, and it's a good thing: The real danger would be that one burst tube would damage the tube next to it, which would burst too, and so on in a cascade of failures that would throw metal parts throughout the primary and secondary coolant loops, damaging valves and reactor fuel assemblies, blocking water flow, and damaging the other SG. And then what? Fukushima USA: An inability to cool the reactor -- a meltdown.

San Onofre avoided that, but their troubles had only just begun.

After letting the reactor cool for several days, technicians went in and started trying to discover what had gone wrong with Unit III's new steam generators. Was it "just" wear, like Unit II was experiencing? It doesn't appear to be the same problem: SanO employees identified 129 tubes that appeared to be excessively worn, and started pressure-testing them. This involves increasing the pressure in one tube at a time to about three times the normal operating pressure. Seven tubes have failed these tests already, and they've only just begun that phase of the testing!

Will it ever be safe, or reasonable, to restart these reactors with Mitsubishi Heavy Industry's steam generators? When BOTH units are having problems? (Exactly ONE tube in Unit II was pressure tested in light of the problems with Unit III. That one tube passed the test. All pressure tested tubes are plugged up permanently, and can no longer be used.)

There can be little doubt now that MHI has been delivering products with criminally-negligent workmanship, and San Onofre has been accepting those parts and using them.

One meltdown at SanO -- or two -- would destroy everything we love about SoCal. Why spend billions of dollars just to restart THAT risk? Right now we just have the spent fuel to deal with -- the radioactive waste pile. It's deadly, difficult to manage, and will cost a fortune. But at least it's NOT GROWING at the moment, and that's good. In fact, slowly but surely, it's cooling and becoming less hazardous.

Restarting San Onofre is just plain stupid!
